US District Judge Matthew J. Kacsmaryk blocked approval of the abortion drug mifepristone by the Food and Drug Administration, while US District Judge Thomas O. Rice ordered the FDA to retain access to the medication in select states. The conservative groups sued the FDA, where in response, the Democratic state attorneys general sued the Democratic Biden administration. As stated by Lawrence Gostin, a professor of global health law at Georgetown University, believes both lawsuits are problematic in the situation that they undermine the FDA’s authority to assess and approve medications.
